Who can adopt?
In the state of Utah, you can legally adopt a child if you are over the age of 21, regardless of home ownership, marital status, income level and work outside the home or the existence of other children. The child must be at least 10 years younger than you. However, in Utah, cohabitating couples who are not married are specifically prohibited from adopting, this includes same sex couples. The adoption process
The process is different for each different kind of adoption. In general, you file a petition for adoption in district or juvenile court. When a parent objects or refuses to give up their rights, the adoption is contested. Parents have 30 days to contest the adoption. The court does not finalize adoptions until the person has lived in the adoptive home for a certain period. For stepchildren, the time period is one year. For others, it’s six months.
